Subject to the terms and conditions of this End User License Agreement ("Agreement"), Got Live Bait LLC ("Licensor") hereby grants you ("Licensee" or "you") a limited, non-exclusive, non-transferable, revocable license to use the Bait Locator mobile application ("App") on devices that you own or control.
You may not:
The App, including all intellectual property rights therein, is and shall remain the exclusive property of Got Live Bait LLC and its licensors. This Agreement does not grant you any rights to use the Licensor's trademarks, service marks, logos, domain names, or other brand features.
You retain ownership of any content you submit, post, or display through the App ("User Content"). By submitting User Content, you grant Got Live Bait LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such User Content for the purpose of operating and providing the App.
Got Live Bait LLC may, from time to time, provide updates, modifications, or enhancements to the App. You agree that Got Live Bait LLC has no obligation to provide such updates. This Agreement shall govern any updates, modifications, or enhancements provided by Got Live Bait LLC that replace or supplement the original App.
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. GOT LIVE BAIT LLC DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOT LIVE BAIT LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.
The App may contain links to third-party websites, services, or resources. Got Live Bait LLC is not responsible for the availability, accuracy, or content of such third-party services. Your interactions with third-party services are solely between you and the third party.
The App is subject to United States export laws and regulations. You may not download, use, or export the App in violation of any applicable export laws or regulations. You agree to comply with all international and national laws that apply to the App, including restrictions on destinations, end users, and end use.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Got Live Bait LLC operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
This Agreement constitutes the entire agreement between you and Got Live Bait LLC regarding the use of the App and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the App.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
